General Terms and Conditions of Commercers Solutions GmbH

§ 1 Scope of application

For the contractual relationship for the delivery of goods between Commercers Solutions GmbH (hereinafter com) and the non-commercial, natural and adult customer (hereinafter referred to as customer), the following General Terms and Conditions (GTC) shall apply exclusively in the version available on the Internet at the time of the order. Verbal collateral agreements are not permitted and will not be made. The GTC may be saved and/or printed out for the purpose of the order.

§ 2 Conclusion of contract

The customer orders goods from com via an online form on the Internet. To do this, he places the desired items in the shop shopping basket and completes the order by clicking on the order button at the end of the ordering process. However, the contract between the customer and com is only concluded by acceptance by com. This takes place through payment by the customer, sending of the confirmation of dispatch by e-mail or post or, at the latest, through delivery of the goods, whereby the option which occurs first is decisive. Orders will only be accepted under the conditions of the website and these terms and conditions while stocks last. If the order exceeds the usual household quantities or the maximum order quantity stored in the shop, it requires the express consent of com. The text of the contract will be saved by com after the conclusion of the purchase and additionally sent to the customer by e-mail. Registered customers also have the option of viewing the contract in their customer account at any time.

In the case of an order for products subject to the protection of minors (such as alcohol), the customer confirms that he is of age by placing the order. Com will also instruct the shipping service provider to check the customer's age of majority at the time of delivery.

§ 3 Price

As a matter of principle, the prices in the online shop include the applicable value added tax. The prices at the time of the order apply. Additional costs such as shipping charges are shown in the order process and are also separately linked and indicated in the product description. In the case of deliveries to customers outside the European Union, additional fees such as customs duties and/or transaction fees may apply, which are to be paid by the customer separately and independently of com.

§ 4 Decoration

The price quoted refers exclusively to the goods specified in the description. Items displayed in pictures for decoration or illustration purposes are expressly not included in the price unless stated in the text.

§ 5 Customisation

For some products, com may offer a customisation function. A possible preview function in the case of individualisation serves exclusively to illustrate the individualisation and not as a representation of the final result. We will then optimally implement the desired individualisation within the framework of production.

§ 6 Underdelivery

In the case of non-delivery of an ordered article due to under-delivery, incorrect delivery or defective delivery by com, com reserves the right to withdraw from the contract as long as com is not responsible for this and a subsequent delivery cannot be reasonably expected of com.

§ 7 Payment

The purchase price shall become due upon conclusion of the order. The customer can pay with the payment methods indicated in the shop under "Payment methods".

§ 8 Delivery

Unless otherwise agreed, the goods will be delivered from the warehouse to the delivery address specified by the customer after receipt of payment. The duration until delivery can be found in the product and/or shipping information and is always based on the receipt of payment. The respective valid shipping prices are stated in the order process and automatically included in the total sum, which the customer can see, check and confirm by clicking on the buy button before completing the order.
Upon delivery of the goods, the risk for the ordered goods is transferred to the customer. If the customer does not accept the goods, com has the right to withdraw from the contract or to demand compensation after the fruitless expiry of a grace period of two weeks. The delivered goods are to be accepted by the customer even in cases of insignificant defects, without prejudice to his warranty rights.

§ 9 Retention of title

Until full payment of all goods from the same order, the goods remain the property of com.

§ 10 Right of withdrawal

Consumers are generally entitled to a right of revocation. Further information on the right of withdrawal can be found in the revocation policy. However, customers whose shipping/address is not within the EU do not have a right of withdrawal.

§ 11 Warranty

The statutory warranty rights apply to all goods from our shop.

§ 12 Information on online dispute resolution

The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to initially resolve disputes in connection with their online order without having to go to court. The dispute resolution platform can be accessed via the link (external link) https://ec.europa.eu/consumers/odr. Com is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 14 Applicable law

In the event of disagreements and legal disputes, the law of the Federal Republic of Germany shall apply exclusively.

§ 1 Geltungsbereich

Für die Vertragsbeziehung zur Lieferung von Waren zwischen der Commercers Solutions GmbH (nachfolgend com) und dem nichtgewerblichen, natürlichen und volljährigen Besteller (nachfolgend Kunde) gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen (AGB) in der zum Zeitpunkt der Bestellung im Internet vorliegenden Fassung. Mündliche Nebenabreden sind unzulässig und werden nicht getroffen. Die AGB können für den Zweck der Bestellung gespeichert und/oder ausgedruckt werden.

§ 2 Vertragsabschluss

Der Kunde bestellt per Online-Formular im Internet Waren bei com. Hierzu legt er die gewünschten Artikel in den Shop-Warenkorb und schließt die Bestellung mit Klick auf den Bestell-Button am Ende des Bestellprozesses ab. Der Vertrag zwischen dem Kunden und com kommt jedoch erst durch die Annahme durch com zustande. Dies erfolgt durch Zahlung des Kunden, Zusendung der Versandbestätigung per eMail oder Post oder spätestens durch Zustellung der Ware wobei die zuerst eintretende Option ausschlaggebend ist. Es werden nur Bestellungen zu den Bedingungen der Website und diesen AGB angenommen, solange der Vorrat reicht. Übersteigt die Bestellung die haushaltsüblichen Mengen oder die im Shop hinterlegte Maximalbestellmenge, bedarf es der ausdrücklichen Zustimmung von com. Der Vertragstext wird durch com nach Kauf-Abschluss gespeichert und dem Kunden zusätzlich per Mail zugeschickt. Registrierte Kunden haben darüber hinaus jederzeit die Möglichkeit den Vertrag in ihrem Kundenkonto einzusehen.

Im Falle einer Bestellung von dem Jugendschutz unterliegenden Produkten (wie Alkohol) bestätigt der Kunde mit Aufgeben der Bestellung, dass er volljährig ist. Com wird weiterhin den Versanddienstleister beauftragen die Volljährigkeit des Kunden bei Zustellung zu überprüfen.

§ 3 Preis

Grundsätzlich werden die Preise im Onlineshop inkl. der gültigen Mehrwertsteuer angegeben. Es gelten die Preise zum Zeitpunkt der Bestellung. Darüber hinausgehende Kosten wie Versandgebühren werden im Bestellablauf ausgewiesen und sind zusätzlich in der Produktbeschreibung gesondert verlinkt und angegeben. Im Falle von Lieferungen an Kunden außerhalb der Europäischen Union können ggfs. weitere Gebühren wie beispielsweise Zölle und/oder Transaktionsgebühren anfallen, die vom Kunden gesondert und unabhängig von com zu zahlen sind.

§ 4 Dekoration

Der angegebene Preis bezieht sich ausschließlich auf die in der Beschreibung angegebenen Waren. Artikel, die zu Dekorationszwecken oder zur Veranschaulichung auf Bildern angezeigt werden sind ausdrücklich nicht im Preis inbegriffen, außer es wird im Text angegeben.

§ 5 Individualisierung

Bei einigen Produkten bietet com ggfs. eine Individualisierungsfunktion. Eine mögliche Vorschaufunktion im Falle einer Individualisierung dient ausschließlich zur Veranschaulichung der Individualisierung und nicht als Darstellung des Endergebnisses. Wir weden die Wunschindividualisierung dann im Rahmen der Produktion optimal umsetzen.

§ 6 Unterlieferung

Für den Fall einer Nichtlieferbarkeit eines bestellten Artikels aufgrund von Unter-, Falsch- oder Mangelbelieferung von com, behält sich com ein Rücktrittsrecht vor solange com dies nicht zu vertreten hat und eine Nachlieferung com nicht zuzumuten ist.

§ 7 Zahlung

Mit Bestellabschluss wird der Kaufpreis fällig. Der Kunde kann mit den im Shop unter "Zahlungsarten" angegebenen Zahlarten bezahlen.

§ 8 Lieferung

Die Lieferung der Ware erfolgt, soweit nichts anderes vereinbart worden ist, ab Lager an die vom Kunden angegebene Lieferadresse nach Zahlungseingang. Die Dauer bis zur Auslieferung ist der Produkt- und/oder Versandinformation zu entnehmen und richtet sich stets nach dem Zahlungseingang. Die jeweils gültigen Versandpreise werden im Bestellvorgang angegeben und automatisch in die Gesamtsumme einberechnet, die der Kunde vor Bestellabschluss sehen, prüfen und durch Klick auf den Kaufen-Button bestätigen kann.
Mit Auslieferung der Ware geht die Gefahr für die bestellte Ware auf den Kunden selbst über. Nimmt der Kunde die Ware nicht an, steht com nach fruchtlosem Ablauf einer Nachfrist von zwei Wochen das Recht zu, vom Vertrag zurückzutreten oder Schadensersatz zu verlangen. Die gelieferte Ware ist auch in Fällen unerheblicher Mängel vom Besteller unbeschadet seiner Gewährleistungsrechte anzunehmen.

§ 9 Eigentumsvorbehalt

Bis zur vollständigen Bezahlung aller Waren aus derselben Bestellung bleibt die Ware im Eigentum von com.

§ 10 Widerrufsrecht

Verbrauchern steht grundsätzlich ein Widerrufsrecht zu. Nähere Informationen zum Widerrufsrecht ergeben sich aus der Widerrufsbelehrung. Kunden, deren Versand-/Adresse sich hingegen nicht innerhalb der EU befindet, steht kein Widerrufsrecht zu.

§ 11 Gewährleistung

Bei allen Waren aus unserem Shop bestehen die gesetzlichen Gewährleistungsrechte.

§ 12 Informationen zur Online-Streitbeilegung

Die EU-Kommission stellt eine Plattform für außergerichtliche Streitschlichtung bereit. Verbrauchern gibt dies die Möglichkeit, Streitigkeiten im Zusammenhang mit ihrer Online-Bestellung zunächst ohne die Einschaltung eines Gerichts zu klären. Die Streitbeilegungs-Plattform ist unter dem Link (externer Link) https://ec.europa.eu/consumers/odr erreichbar. Com ist zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle weder verpflichtet noch bereit.

§ 14 Anwendbares Recht

Bei Meinungsverschiedenheiten und Rechtsstreitigkeiten gilt ausschließlich das Recht der Bundesrepublik Deutschland.
